Just to put this in the mix.if it was deemed that the accident was caused by the old lady, then wouldn't this be a case of hit and run, well hit and walk. she shot off very quick.although that could of been the shock of it all.

ha, now this would have nothing to do with who is right or wrong , it would just be a simple case of being a money spinner.

I don't think its the rider's fault but he could have prevented that accident from happening and it could have been a lot worse.

He was going too fast, (recent case law supports filtering at no more than 10 mph faster than the surrounding traffic and no more than 30 mph total). He wasn't looking about or over the cars (he would have seen her). Whistling and singing music (suggests he's not 100% focused) and the white van could have taken him out if it had pulled out on him which happens frequently.
Also as a rider you got to expect everyone else to be a dick.

Hopefully he'll realise he had a lot to play in that and will learn from it.

If Learner riders / drivers had to complete their theory test before being allowed to use the roads then the hazard perception part would have benefitted this guy. Learners on a cbt arent conditioned to look out for hazards in the same way that someone who has trained for it to pass their theory.

Why? Maybe it's my Southern turn of phrase.

    This is my opinion.

He's a new rider. Young lad with not a care in the world.

She on the other hand was an old bird (but not past it or without her faculties) so should know metal/ plastic vehicles in the road will hurt her so she should have the experience and brains to have looked more carefully.

She stepped out in front of him because she didn't look at all.

He could / should have been slower and looking around more = sounding horn, covering brakes and stopping before he hits her.

If it had been me riding I would expect to get the blame as I should know better.

I agree with your opinion of the woman , as for the rider irrelevant of young / old / new / experienced / whatever , it was clear that the woman could be observed clearly being in a rush and making her move into the traffic , the fact is he hit her and it could have and should have been avoided , make a mistake and you pay the price.

Biker 100% NOT at fault IMO.

"That van coulda pulled out!" << where was it going to go?

The dozy bint ran out into traffic without looking, not once did she look to her left.
At the point where she did step in to the road she was obscured by the silver car (micra?)
She didnt even look at what hit her....

Legally her fault...she ran across a public highway not using a crossing.

Her fault for being a daft old bint and not looking.

But, in her defense...the guy on the bike should have easily noticed her and wacked on the brakes.

You've got to remember too - his camera is on top of his lid. The camera can see more than him...so she probably just popped out of nowhere and he did what he could.

I haven't read any comments in this thread because I don't want them to sway my judgement...so I'm gonna go back and read them and see what I've missed :D

    **Edit**

Nothing new from other comments. But people saying he should have went after her?

He asked her to stay there whilst he parked up and she ran off. Not his job to stop her.

As far as I'm concerned she is guilty of hit & run. I'd be tracking her down and billing her for the damage.

"Could you not go any faster"....she says as she runs into a road without looking?!

I wish people would stop coming up with ridiculous reason why stupid people are not in the wrong.

Those who think the rider was at fault are responsible for allowing the rise of the retards, great work there people.

Actually, the people who are blaming the rider are even more retarded than the woman who didnt look before crossing the road.

Is it 10 or 20 points for crashing into a woman? And is it 20 bonus points cause shes an OAP? So 40 points isnt too bad for a minutes ride, obviously would have been much more rewarding to mow down a stinking chav or pikey but you have to take what you can on a slow day
